Terms of Service - Maple Court Tennis Academy

1. Introduction and Acceptance of Terms

These Terms of Service (the "Terms") govern your access to and use of the services, programs, facilities, websites, communications, and related offerings provided by Maple Court Tennis Academy (the "Academy", "we", "us", or "our").

By registering for, booking, attending, purchasing, or otherwise using any service offered by Maple Court Tennis Academy, you agree to be bound by these Terms. If you are accepting these Terms on behalf of a minor, you represent and warrant that you are the parent or legal guardian of that minor and that you have authority to bind the minor to these Terms.

If you do not agree to these Terms, you must not use our services.

2. Scope of Services

Maple Court Tennis Academy provides tennis-related instruction and training services, which may include, without limitation:

  • Private tennis coaching;
  • Group tennis lessons;
  • Junior development programs;
  • Adult beginner clinics; and
  • Competitive match play training.

Services may be delivered in person, at third-party facilities, or through other arrangements as communicated by the Academy. We may modify, suspend, or discontinue any service, schedule, coach assignment, or program structure at any time, subject to applicable law and any specific written agreement.

The Academy does not guarantee specific athletic outcomes, rankings, performance improvements, selection outcomes, or competitive results.

3. User Obligations and Responsibilities

By using our services, you agree to:

  • Provide accurate, current, and complete registration and contact information;
  • Ensure that you or your child are physically and medically fit to participate in tennis activities;
  • Disclose any relevant medical conditions, injuries, allergies, or limitations that may affect participation;
  • Follow all safety instructions, facility rules, coach directions, and conduct requirements;
  • Use appropriate tennis attire and equipment, unless otherwise specified by the Academy;
  • Refrain from abusive, disruptive, discriminatory, unsafe, or unlawful conduct;
  • Respect the property of the Academy, other participants, coaches, and third-party facilities; and
  • Supervise minors as required and ensure timely drop-off and pick-up where applicable.

You acknowledge that tennis is a physical activity involving inherent risks, including but not limited to slips, falls, collisions, overexertion, equipment-related injuries, weather-related risks, and injuries caused by the actions of others.

The Academy may refuse, suspend, or terminate participation for any person whose conduct is unsafe, disruptive, or inconsistent with these Terms or applicable law.

4. Payment Terms and Conditions

Fees for services, memberships, packages, clinics, or programs will be communicated at the time of registration, booking, or purchase. Unless otherwise stated in writing, all fees are payable in Canadian dollars (CAD).

  • Payment is due in full at the time of booking or by the deadline specified by the Academy;
  • The Academy may require deposits, prepayment, or recurring payment authorization for certain services;
  • Late payments may result in suspension of services, cancellation of bookings, or administrative fees where permitted by law;
  • Applicable taxes, including GST/HST and any other required taxes, will be added where applicable;
  • Returned payments, chargebacks, or payment disputes may result in additional administrative charges to the extent permitted by law.

Promotional pricing, discounts, and package rates may be subject to eligibility requirements, limited availability, and expiration dates. Unless expressly stated otherwise, fees are non-transferable.

5. Cancellation and Refund Policy

Cancellation and refund terms may vary depending on the type of service, program, or booking. Any service-specific cancellation policy communicated at registration or booking will apply in addition to these Terms.

  • Private lessons: Cancellations made within the notice period specified by the Academy may be rescheduled or refunded at the Academy's discretion; late cancellations or no-shows may be charged in full;
  • Group lessons and clinics: Missed sessions are generally non-refundable and non-make-up unless otherwise stated;
  • Junior development programs and competitive training: Refunds, if any, may be prorated based on attendance and administrative costs, subject to the Academy's written policy;
  • Weather, facility closures, or coach unavailability may result in rescheduling, credit, or refund at the Academy's discretion, subject to applicable law and any third-party facility rules.

Unless otherwise required by applicable law or expressly stated in writing, all refunds are issued at the Academy's discretion and may exclude non-recoverable administrative or processing fees.

To request cancellation or a refund, you must contact the Academy using the contact details below and provide the relevant booking or account information.

6. Liability Limitations

To the fullest extent permitted by the laws of Canada and the applicable province or territory, Maple Court Tennis Academy, its directors, officers, employees, coaches, contractors, agents, affiliates, and facility partners shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, loss of opportunity, loss of data, or business interruption arising out of or related to your use of the services.

You acknowledge and agree that participation in tennis and related physical activities involves inherent risks. You assume all risks associated with participation, except to the extent caused by the gross negligence, wilful misconduct, or other liability that cannot be excluded under applicable law.

Nothing in these Terms is intended to exclude or limit liability where such exclusion or limitation is prohibited by applicable Canadian law, including liability for death or personal injury caused by negligence where such limitation is not legally enforceable.

If the Academy provides equipment or access to facilities, such provision is made on an "as is" basis, subject to any non-excludable statutory warranties or consumer protections that may apply.

7. Intellectual Property Rights

All content, materials, training plans, lesson formats, logos, trademarks, text, graphics, videos, photographs, documents, and other intellectual property made available by Maple Court Tennis Academy are owned by or licensed to the Academy and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use Academy materials solely for personal, non-commercial purposes related to your participation in our services.

You must not copy, reproduce, distribute, modify, publish, sell, sublicense, or create derivative works from Academy materials without our prior written consent.

Any feedback, suggestions, or ideas you provide to the Academy may be used by us without restriction or compensation, unless otherwise agreed in writing and permitted by law.

8. Data Protection and Privacy

Maple Court Tennis Academy collects, uses, stores, and discloses personal information in accordance with applicable Canadian privacy laws, which may include the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation.

We may collect personal information such as names, contact details, emergency contacts, health-related information relevant to safe participation, payment information, attendance records, and communications history.

We use personal information to:

  • Register participants and manage bookings;
  • Provide coaching and related services;
  • Communicate schedules, cancellations, updates, and administrative notices;
  • Process payments and refunds;
  • Maintain safety, incident, and attendance records;
  • Comply with legal and regulatory obligations; and
  • Improve our services and operations.

We take reasonable administrative, technical, and physical safeguards to protect personal information. However, no method of transmission or storage is completely secure.

9. Force Majeure

The Academy shall not be liable for any delay, interruption, cancellation, or failure to perform caused by events beyond its reasonable control, including but not limited to severe weather, fire, flood, epidemic, pandemic, public health restrictions, labour disputes, power outages, facility closures, government actions, transportation disruptions, or acts of God.

In such circumstances, the Academy may reschedule services, provide credits, modify delivery methods, or cancel affected services without liability except as required by applicable law or expressly stated in a written policy.

10. Changes to Terms

Maple Court Tennis Academy may update or revise these Terms at any time by posting the updated version on our website or by otherwise notifying participants where appropriate.

Changes will become effective on the date indicated in the revised Terms, unless otherwise required by law. Your continued use of our services after the effective date of any changes constitutes acceptance of the revised Terms.

11. Applicable Law and Jurisdiction

These Terms and any dispute arising out of or relating to them shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Subject to any mandatory consumer protection or other non-waivable legal rights, the parties attorn to the exclusive jurisdiction of the courts located in Ottawa, Ontario, Canada for the resolution of any dispute arising from or related to these Terms or the services provided by Maple Court Tennis Academy.

13. Severability Clause

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

If any invalid or unenforceable provision can be modified to make it valid and enforceable, it shall be interpreted and enforced to the maximum extent permitted by law in a manner that most closely reflects the original intent of the provision.

By using the services of Maple Court Tennis Academy, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
